At Go-Share, we take your privacy seriously – we believe that your data is yours and you should have full control and visibility over it at all times. The following Privacy Policy governs the information collection practices of Go-Share (“Company,” "we" or "us") from online means. It outlines the types of information that we gather about you which you disclose while using the website, mobile application and online portal (collectively referred to as “Platform”). 

When starting to use the Platform, this Privacy Policy is presented and you are asked for consent. We also inform you about your rights and the conditions under which we share information about you with others. This document explains why we collect certain personal information and how we protect the information that you provide to us. The General Data Protection Regulation (GDPR) is in effect as of May 25, 2018. As a result, from that date, the same privacy legislation applies throughout the European Union (EU). Go-Share's Privacy Policy has been drawn up in accordance with this legislation.

We also provide the contact information of the Data Protection Officer and the Supervisory Authority to be contacted in case you wish to request any information with respect to your rights

Scope and Purpose  

Go-Share collects, processes, and uses personal information to provide carpooling services to our corporate clients. Personal information includes data such as employee names, contact details, location data and payment information. We also collect data from employees' devices, such as images shared on the Platform, and browser information. We do not share this information with our third-party service providers to facilitate our carpooling services. 

This notice does not cover:  

• Data that is not personal, like anonymous or aggregated information (not including any personal identifiers), even if it comes from personal data.

Depending on the context of personal information you provide, Go-Share may be the data controller ("controller") or data processor ("processor") of your personal information under this policy. Go-Share acts as the controller in relation to any personal data collected through the use of cookies and analytics tools, data collected through the website enquiry forms and any pseudonymized data stored by Go-Share. 

Further, it is the processor of personal information processed for providing services as a part of Go-Share’s Agreement with your Employer or other affiliates. Such agreement may involve processing of personal data under our client's control on our Platform.

What personal information do we collect about you? 

We collect personal data about you in several primary ways:

• Directly from you, like when you register an account with us. 
• Automatically from your use of our Platform, like data associated with using our network.

Here are the types of information we collect:

Personal Data that you provide to us directly:

• Information collected from the Portal includes your full name, phone number, company details such as name, corporate email-address, physical address and VAT number.
• Information collected from the mobile application includes your username, password, location, Bluetooth, video data like profile image and images uploaded from your camera depicting damage to the fleet and text chats between the driver of the ongoing fleet and the operational manger.
• Our website contains contact forms that can be used for electronic contact or to enquire about the services provided by Go-Share. If you decide to contact us via a contact form, the data entered is transmitted to us and stored. This includes first name, last name, company name, corporate e-mail address, job title.

Personal data that we collect automatically:

When you use our Platform, we may automatically collect certain data about your device and usage of our services. This may include data relating to and obtained from use of technologies such as cookies and analytics tools. By using our services, you consent to our automatic collection of this data. For further information on cookies and technologies used to collect such data, please refer to our Cookie Policy. 

For what purpose do we collect your data? 

Go-share uses the data it collects for purposes including:

• Fulfillment of services - We use the collected data to provide, personalize, maintain and improve our services. This includes using the data to
• Create and update user accounts;
• Enable car-pooling services on the Platform;
• Offer, process or facilitate payments for the services;
• To manage and respond to any request you submit through our website;
• Perform internal operations necessary to provide our services, including monitoring and troubleshooting software bugs and operational problems, to conduct data analysis, testing and research.
• Legal and regulatory requirement – We may use the personal data collected to investigate or address claims or disputes relating to use of Go-Share's services, or as otherwise allowed by applicable law or as requested by regulators, government agencies and official inquiry requests. 

Legal basis of data collection

Go-Share may rely on the following lawful reasons when we process your personal data to operate our business and provide our products and services:

• Contract: We may process personal information to fulfill our contractual obligations to which the client (data controller) is party. 
• Consent: We rely on your freely given, specific, informed and unambiguous consent at the time you provide your personal information to us for one or more specific purposes.
• Legitimate Interests: We may process your personal data for certain legitimate interests such as improving our services and protecting our business interests. We will only process your personal data if such processing is necessary, proportionate, and does not override your interests and rights.

What about cookies and other identifiers?

We use cookies in order to provide a better service or identify which pages on the Platform are of special interest. A cookie is a small piece of information which a website stores on your web browser and which can later be retrieved.

Does Go-Share provide service(s) to minors?

Go-Share’s website is not intended for children and minors and we do not knowingly solicit or collect Personal Data from anyone under the age of 18 and if we become aware that we have inadvertently collected personal data from a minor, we will take steps to delete the data as soon as possible.

If you are a minor and have accessed our website, please do not provide any personal data. If you believe that we may have collected personal data from you, please contact us at helpdesk@tejkshter.nl  and we will take steps to delete the data.

Does Go-Share share your information with third-parties?

In connection with your visit to our Platform and use of our services, Go-Share may share your information in the following cases: 

• As part of a corporate business transaction, like a merger or acquisition, divestiture, sale of company assets, or in the event of insolvency, bankruptcy, or receivership. In these cases, personal data could be transferred to third parties as a business asset. We may also share information with banks and similar entities for purposes of transferring loans in connection with device financing.
• We may also disclose your data to additional third parties, including government authorities, for legal processes or protection of life and safety where we believe that access, use, preservation, or disclosure of the information is reasonably necessary, including:
  • To comply with laws, regulations, legal process or to respond to lawful requests;
  • To protect the rights, interests, property, or safety of Go-Share, our customers, and others;
  • In connection with claims, disputes, or litigation;
  • To protect you or others from fraudulent, abusive, or unlawful use of these services, and other fraudulent activity and;
  • In an emergency.

Where does Go-Share transfer (cross-border transfer) your data?

Go-Share is committed to protecting the privacy of our users and their personal information. To that end, we will not transfer any personal information collected through our services outside of the country in which it was collected, unless we have obtained the user's explicit consent or there are adequate safeguards in place to ensure the protection of the data in accordance with applicable data protection laws.

In the event that we do transfer personal information outside of the country in which it was collected, we will ensure that appropriate measures are taken to protect the privacy and security of the data.

How long does Go-Share store your data?

Go-Share will retain your personal information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.

In the event of termination of contract, after a period of 12 months, we will pseudonymize your data to protect your privacy. 

You may request the deletion of your personal data at any time by contacting us at helpdesk@tejkshter.nl. We will promptly delete your data, subject to any legal or contractual obligations that may require us to retain it.

How does Go-Share protect your data?

Go-Share has implemented appropriate technical and organizational measures to safeguard and help prevent unauthorized access to your information and to maintain data security. These safeguards take into account the sensitivity of the information that we collect, process and store and the current state of technology. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. 

We can’t guarantee our safeguards will prevent every unauthorized attempt to access, use, or disclose personal data as despite our best efforts, no security measures are perfect or impenetrable. 

What are your rights under the EU-GDPR? 

Go-Share provides you the ability to exercise certain rights regarding our collection, use and sharing of your information. However, if Go-Share processes your personal information as a processor to provide services as part of our agreement with your Employer or their affiliates, you should first look to them for assistance regarding exercising rights relating to processing your personal information.

In accordance with applicable law, your rights include:

• Right to access: This right allows you to obtain a copy of your personal information, as well as

other supplementary information. 

• Right to restrict processing: You have the right to restrict the processing of your personal information in certain circumstances. 
• Right to rectification: You have the right to have any incomplete or inaccurate information we hold about you corrected.
• Right to object to processing: The right to object allows you to stop or prevent us from processing your personal information. This right exists where we are relying on a legitimate interest as the legal basis for processing your personal information. 
• Right to erasure: You have the right to ask us to delete or remove personal information when the personal information is no longer necessary for the purpose which we originally collected or processed. 
• Right to data portability: You have the right to receive your personal information that you have provided to Go-Share, in a structured, commonly used and machine-readable format. 
• Right to withdraw consent: You may withdraw your consent that you have previously given to one or more specified purposes to process your personal data. 
• Right to lodge a complaint: You have the right to lodge a complaint to the Supervisory Authority. Additionally, you can also lodge a complaint with the data protection officer (see address below).

You can exercise these rights by contacting us using the contact details at the end of this document. If your request us to delete your personal information, the result may be that we can no longer provide our services to you.

Changes to the Policy 

From time to time, Go-Share may change this privacy policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes. We will provide a notice to you if these changes are material and, where required by applicable law, we will obtain your consent. Notice may be sent via email to you at the last email address you provided us, by posting notice of such changes on our sites and applications, or by other means, consistent with applicable law.

If you continue interacting with us in a business context or continue to use our products and services after we notify you, we’ll take that to mean you’re fine with the changes for any new data we collect. Those changes will not apply to the previously collected personal data unless we get consent from impacted individuals.
